Terms & Conditions – Aruba 414 Condo (Direct Bookings)
These Terms & Conditions (“Agreement”) govern all direct bookings made with Aruba 414 Condo (“Owner,” “we,” “our,” or “us”). By submitting payment, the guest (“Guest”) agrees to the following terms:
1. Booking & Payment Terms
A 50% deposit is required to secure the reservation dates. The remaining 50% balance is due 14 days prior to check-in. A refundable damage deposit may be required and is typically due with the final payment. Reservations are not fully confirmed until the initial deposit is received. Failure to submit the remaining balance by the due date may result in cancellation of the reservation with no refund of amounts already paid.
2. Cancellation Policy
All cancellations are subject to our published Cancellation Policy. All payments are subject to the cancellation terms, and any applicable refunds are based on the total reservation amount, not the amount paid to date. All cancellations must be submitted in writing and are effective on the date received.
3. Occupancy & Use
Only registered guests are permitted to stay at the property. Maximum occupancy limits must be strictly followed. The property may not be used for parties, events, or unlawful activities. Violation of these terms may result in immediate termination of the stay without refund.
4. Damage Deposit
A refundable damage deposit may be collected prior to check-in. The deposit will be refunded after check-out, provided there is no damage to the property or contents, no excessive cleaning is required, and no violations of house rules occurred. Deductions may be made at the Owner’s discretion for damages, missing items, or policy violations.
5. Check-In / Check-Out
Check-in and check-out times must be followed unless otherwise approved. Unauthorized late check-out or early check-in may result in additional charges.
6. Guest Responsibilities
Guests agree to maintain the property in good condition, follow all posted house rules and instructions, and report any damages or issues promptly. Guests are responsible for any damage caused by themselves or their party.
7. Limitation of Liability
Aruba 414 Condo is not liable for injury, loss, or damage to personal property; accidents or incidents occurring during the stay; or interruptions to utilities, internet, or building amenities beyond our control. Use of the property is at the Guest’s own risk.
8. Third-Party Services
We are not responsible for services outside our control, including airlines or travel providers, weather conditions, building amenities managed by the HOA, or third-party booking tools or payment platforms such as Zelle and Venmo.
9. Chargebacks & Payment Disputes
By submitting payment, Guest agrees not to initiate chargebacks or payment disputes without first contacting us to resolve the issue and acknowledges that all payments are authorized under these Terms. Any unjustified chargebacks may result in additional fees, collections, or legal action.
10. Right to Refuse or Terminate Stay
We reserve the right to refuse service or terminate a reservation at any time if terms are violated, fraudulent activity is suspected, or behavior is deemed unsafe or inappropriate. No refunds will be issued in such cases.
11. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the property is located.
12. Security Cameras & Noise Monitoring
For the safety and security of the property and guests, the premises may be equipped with exterior security cameras. Cameras are located in public and exterior areas only, which may include building common areas, entry points, and balcony areas. Cameras are not located inside the unit or in any private interior spaces. Cameras are used solely for security, safety, and verification of occupancy and rule compliance. Tampering with or disabling security devices is strictly prohibited and may result in immediate termination of the stay without refund. By booking and staying at the property, Guest acknowledges and consents to the presence of these devices.
13. HOA & Building Rules
The property is located within a managed community with shared facilities and standards. Guests agree to comply with all applicable building and community (HOA) rules, respect quiet hours, neighboring residents, and shared spaces, and follow all posted rules within the unit or property grounds. Failure to comply may result in warnings or fines imposed by the building, immediate termination of the stay without refund, and charges for any penalties incurred due to Guest actions. Owner is not responsible for restrictions, closures, or changes to shared amenities controlled by the building or HOA.
14. Acceptance of Terms
By submitting payment, completing booking forms, or occupying the property, Guest acknowledges and agrees to these Terms & Conditions.
